VESSEL SOLUTIONS SA DE CV, with address at Blvd. Acabadores 310, Colonia Cd. Industrial, in the city of León, Guanajuato, C.P. 37490, hereby informs you that the personal data you provide as a customer or prospective customer will be processed by VESSEL SOLUTIONS SA DE CV, through its Personal Data Processing Department, strictly for the purposes set out below.
The personal data to be processed by VESSEL SOLUTIONS SA DE CV, through its Personal Data Processing Department, consists of information about the data subject, which may include, by way of example and without limitation, the following:
Your full name, address, date of birth, official identification number, gender, marital status, matrimonial property regime, number of financial dependents, email address, RFC (tax ID), CURP (population ID), telephone numbers, names and details of personal references, as well as accounting, financial and asset information, among others, strictly to the extent necessary for the purposes set out below.
VESSEL SOLUTIONS SA DE CV will collect your personal data without any intention of disclosing it, and will process it solely for the following purposes:
To verify and confirm your identity and financial standing;
To request commercial and personal references from you;
To create, study, analyze, update and maintain your credit file;
To request external assessments from credit investigation agencies in order to obtain your background and credit file, in cases where such assessments are not carried out by the data controller itself;
To request from external companies or agencies any procedures and services before public property registries, municipal authorities, state or federal offices, as well as any others that may become necessary to fulfil a legal obligation between the data controller and the data subject;
To prepare and enter into contracts of sale, consignment, credit, distribution, supply or contract manufacturing, services, and others, where required;
To add and/or update your details in our databases as an existing customer, including your purchase history, for purely statistical purposes and to improve our service;
To supply the products and services required by the customer promptly and correctly;
To inform you about changes to our products or services, as well as about new products or services related to those agreed or purchased by the customer;
To provide information to competent Federal, State or Municipal Authorities or their centralized or decentralized bodies that require or request it.
To provide commercial references to third parties who request them, exclusively regarding the credit and credit behavior of the data subject with the data controller;
To assess the quality of the products or services;
To carry out internal studies on consumption habits and credit behavior.
The data will be kept in the strictest confidence and may not be used for any purpose other than those stated above, unless this Privacy Notice is amended.
It is the data subject's responsibility to ensure that any personal data of third parties (for example personal or commercial references) provided to us already has the authorization of its respective owners to be given to us and processed by us in accordance with this privacy notice.
Once the purpose of the processing has been fulfilled, the data will be retained solely in order to determine any possible liability arising from its processing, until the applicable legal or contractual limitation period has elapsed. During that period the personal data may not be processed, and once it has elapsed the data will be deleted from the corresponding database.
In collecting personal data we follow the principles set out in the law: lawfulness, quality, consent, information, purpose, loyalty, proportionality and accountability.
Personal data will be collected directly from the data subject by completing a form (credit application, update or increase) or through other electronic means (email), or by any other lawful means. In addition, we may obtain information about the data subject from other sources permitted by law, such as telephone directories, references from companies or individuals, and public databases of any public or private entity or agency, among others.
VESSEL SOLUTIONS SA DE CV has the administrative, technical and physical security measures necessary and sufficient to protect your personal data against damage, loss, alteration, destruction, or unauthorized use, access or processing.
Personal data is safeguarded in databases and on computer equipment with the security needed to prevent information leaks.
Our information-security tools are supported by an internal information security policy that explains to staff the security considerations they must bear in mind when using a computer system.

The ARCO request and/or the request to revoke consent must contain and be accompanied by the items set out in Article 29 of the law, namely:
The data subject's name, address and email account so that the response to the request can be communicated.
Documents proving the data subject's identity or, where applicable, their legal representation.
A clear and precise description of the personal data in respect of which the rights are being exercised.
Any other element or document that helps locate the personal data, as well as any other document required by the legislation in force at the time the request is submitted.
VESSEL SOLUTIONS SA DE CV will not be obliged to delete personal data where any of the circumstances established in the law applies, including the following: where it relates to the parties to a private, corporate or administrative contract and is necessary for its performance and fulfilment; where it must be processed by legal provision; where deletion would obstruct judicial or administrative proceedings relating to tax obligations, the investigation and prosecution of offences, or the enforcement of administrative penalties; where it is necessary to protect the data subject's legally protected interests; where it is necessary to carry out an action in the public interest; or where it is necessary to fulfil an obligation lawfully assumed by the data subject.
Personal data will not be disclosed or shared with third parties, with the following exceptions: a) where the data is transferred to a notary public so that an agreement and/or any other act may be formalized involving both the data controller and the data subject and/or those bound by them; b) where external assessments are requested from credit investigation agencies in order to obtain your background and credit file; c) where procedures and services are requested from external agencies before public property registries, municipal authorities, state or federal offices, as well as any others that may become necessary to fulfil a legal obligation between the data controller and the data subject; d) where we provide commercial references to third parties who request them, exclusively regarding the credit and credit behavior of the data subject with the data controller.
If you do not wish VESSEL SOLUTIONS SA DE CV to transfer your personal data for the purposes set out in this notice, please state your objection by email to info@vessel.mx, where it will be dealt with promptly and properly.
This privacy notice will be provided to the third parties to whom data is to be transferred, so that they are aware of the limitations the data subject has placed on the disclosure of their data.
Under the terms of Article 8 of the law, the data subject shall be deemed to have tacitly consented to the processing of their data where, this Privacy Notice having been made available to them, they do not state their objection.
We will have a maximum of 20 business days to respond, through the email address you provide for that purpose, to any request you make regarding the limitation of the use or disclosure of your personal data covered by this notice; to any request regarding your ARCO rights (access, rectification, cancellation or objection); to an objection to the transfer of your personal data; or to the revocation of your consent to the processing of your data. Likewise, where the request is upheld, we will have 15 business days to implement the decision adopted. The above periods may be extended once, for an equal period, provided the circumstances of the case so justify.
